Waiver / liability release

Martial arts and combat sports training can be inherently dangerous activities. Melbourne Grappling Academy (MGA) offers training in Brazilian Jiu-Jitsu (BJJ), Wrestling, and strength and conditioning (S&C) activities. These involve physical contact, takedowns, joint locks, throws, lifting weights, resistance training, and other movements that carry a risk of injury.

These activities may result in minor injuries such as bruises, scratches, and general soreness, as well as more serious injuries including, but not limited to, sprains, strains, broken bones, torn ligaments, concussions, or, in rare cases, permanent disability or death. Injuries can occur even when all safety instructions are followed.

By signing this waiver, you confirm the following:

Assumption of Risk

You understand and voluntarily assume all risks associated with participating in training at MGA, including injuries resulting from martial arts techniques, strength and conditioning activities, training drills, other participants, or the use of equipment and facilities.

Medical Fitness

You confirm that you (or your child, if applicable) are medically and physically fit to participate and have consulted a qualified medical professional if unsure.

Release of Liability

To the extent permitted by law, you release and hold harmless Melbourne Grappling Academy, its owners, instructors, staff, and other participants from any and all liability for injuries, illness, or damages arising from your participation, except where directly caused by proven negligence.

Parental Consent for Minors

If the participant is under 18, a parent or legal guardian must sign this waiver, acknowledging and accepting all risks on behalf of the minor and agreeing to the terms herein.

Health and Safety

You agree to follow all safety instructions and conduct yourself responsibly. Failure to do so may result in removal from training sessions.

Photo and Video Consent

You consent to MGA capturing photos or videos of you (or your child) during training for use in marketing or promotional materials including social media, website content, and print media. If you do not wish for photos or video footage of you or your child to be used, you must notify us in writing prior to attendance. Your choice will be respected at all times.

CCTV Monitoring

MGA uses CCTV in mat and shared areas for security and safety purposes. By signing this waiver, you acknowledge that your training sessions may be recorded.

Data Privacy

By submitting this form, you consent to MGA collecting, storing, and using your personal information for administrative and safety purposes. MGA complies with the Privacy Act 1988 (Cth) and will not share your data with third parties without consent, unless required by law.

Australian Consumer Law

Nothing in this waiver limits or excludes any guarantees, warranties, representations or conditions implied or imposed by Australian law, including the Australian Consumer Law, which cannot be lawfully excluded. This waiver is intended to operate to the fullest extent permissible under applicable law.

Jurisdiction and Severability

This agreement is governed by the laws of the State of Victoria, Australia. If any part of this waiver is found unenforceable, the remaining provisions will remain in full effect.

By signing this document, you acknowledge that you understand and accept the risks involved in martial arts, wrestling, and strength and conditioning training, and agree to release Melbourne Grappling Academy from liability as described above. You participate voluntarily and take full responsibility for your (or your child’s) safety.

These Terms & Conditions apply to all fixed‑term memberships at Melbourne Grappling Academy (MGA). They replace any standard membership terms and are binding for the full membership period you choose.

1. Membership and Payment

  • 1.1 Fixed‑term memberships are available for a 12‑month term.
  • 1.2 Payment for the entire term is required in full at the time of joining.
  • 1.3 Fixed‑term memberships are a commitment for the full term and cannot be cancelled or refunded once purchased.
  • 1.4 Fixed‑term memberships are personal to you and cannot be transferred or shared.

2. Freezes

  • 2.1 Freezes are available for a minimum of 4 weeks and a maximum of 12 weeks during the membership term.
  • 2.2 Written notice must be provided to info@melbournegrappling.com.au at least 2 weeks before the requested freeze start date.
  • 2.3 A $25 administration fee applies for each freeze period.
  • 2.4 If your membership is not reactivated within the agreed freeze period, it will be treated as a cancellation and a $50 rejoining fee will apply if you return.

3. Facility Rules

  • 3.1 Treat all members, coaches, and visitors with respect at all times.
  • 3.2 Only water and sports drinks are allowed on the mats. No food or other drinks are permitted.
  • 3.3 Members are responsible for their own belongings while on site. MGA accepts no responsibility for lost, stolen, or damaged items.
  • 3.4 Parking is available on site in the business estate, or off site in neighbouring streets. Please park considerately, and follow parking regulations.

4. Hygiene and Safety

  • 4.1 Maintain high personal hygiene, including clean training gear, trimmed nails, and a clean body before training.
  • 4.2 Members must report any injury sustained during class that is more than a minor cut or bruise. This includes, but is not limited to: suspected ligament strains or tears, significant joint pain, heavy blows to the head or body, suspected concussions, dislocations, fractures, deep cuts, severe muscle strains, or any injury that may limit safe participation in training.
  • 4.3 Report any pre‑existing injuries or medical conditions to your coach before training.
  • 4.4 Do not train if you are unwell, have a contagious illness, or have open wounds.
  • 4.5 Respect your own limits, and those of your training partners. Unsafe behaviour will not be tolerated.
  • 4.6 Follow all coach and staff instructions immediately, for your safety and the safety of others.

5. Strength and Conditioning (S&C) Area

  • 5.1 Access to the S&C area is included in all adult fixed‑term memberships.
  • 5.2 Only use equipment you understand how to operate safely.
  • 5.3 If unsure, seek guidance from a coach before use.
  • 5.4 Return all equipment after use.
  • 5.5 Wipe down equipment after use.
  • 5.6 No dropping weights, unless using bumper plates in the designated area.
  • 5.7 Spotters are recommended when lifting heavy loads.
  • 5.8 No unsupervised children are allowed in the S&C area, at any time.

6. Public Holidays

  • 6.1 MGA will close for public holidays only. These closures do not extend or adjust the fixed‑term period.

7. Photography and Filming

  • 7.1 Members may take photos or short video clips for personal use, provided it does not disrupt classes or make others uncomfortable.
  • 7.2 Filming or photography of any person without their knowledge and consent is prohibited.
  • 7.3 Taking or sharing photos or videos of children other than your own is prohibited, without the consent of their parent or guardian.
  • 7.4 Members must seek consent from anyone identifiable in their photos or videos before posting online.
  • 7.5 MGA reserves the right to request the removal of any content that breaches these terms, breaches another member’s privacy, or misrepresents the gym.
  • 7.6 Breaches of this clause may result in suspension or termination of membership, without refund.

8. Parents & Guardians (Junior Members)

  • 8.1 Parents or guardians are responsible for their children before and after class. We are only responsible for them during their scheduled class times.
  • 8.2 Parents or guardians must remain on‑site during class unless their child is old enough to attend the toilet independently.
  • 8.3 No children are permitted in the S&C area at any time.
  • 8.4 Parents watching classes should avoid interrupting coaching or giving instructions from the sidelines.

9. Code of Conduct

  • 9.1 Show respect to all coaches, staff, training partners, and visitors.
  • 9.2 No discrimination, harassment, bullying, or abusive behaviour will be tolerated.
  • 9.3 Breaches of this code may result in suspension, or termination, of membership, without refund.

10. Changes to Terms

  • 10.1 MGA may update these Terms & Conditions at any time.
  • 10.2 The most recent version will always be available on our website, and will take effect immediately upon publication.

Note: These Terms & Conditions are in place to keep training safe, fair, and enjoyable for all members. Our aim is to be flexible and helpful wherever possible, but we have to be clear about our policies so the gym runs smoothly for everyone.
